Terms & Conditions

Please read these. terms carefully before booking your Jetcar experience with Beachy.

IMPORTANT INFORMATION

Beachy Beach Club & Jetcar Rentals Ltd. provides premium watersport experiences, including but not limited to jet car rides, jetski experiences, guided water activities, beach-based experiences, private bookings, group bookings, content experiences, and related tourism services in Tobago.
 

All services are subject to availability, weather conditions, sea conditions, safety requirements, operational approvals, and the discretion of Beachy management and authorised staff.

Bookings may be made through our website, telephone, WhatsApp, email, or in person.
 

A booking is only confirmed when the required payment, deposit, or full fee has been received and acknowledged by Beachy.
 

Customers are responsible for ensuring that all booking information provided is accurate, including name, contact information, selected service, date, time, number of participants, and any special requests. Erroneous information can result in cancellation of booking.
 

Beachy reserves the right to correct pricing errors, update service descriptions, modify packages, and refuse or cancel bookings where necessary.

Customers are required to arrive on time for their scheduled booking. We recommend arriving at least 30 minutes beforeyour scheduled activity to allow for check-in, safety briefing, waiver completion, fitting of safety equipment, and operational preparation.

Late arrivals may result in a shortened experience, rescheduling subject to availability, or forfeiture of the booking. Beachy is not obligated to extend ride times or delay other bookings due to late arrival.

Customers must be 18 years or older to make a booking independently.

Persons under the age of 18 may only participate where permitted by Beachy, applicable safety requirements, insurance conditions, and operational guidelines. A minor must be accompanied by a parent, legal guardian, responsible adult, or approved operator where required.

Beachy reserves the right to deny service to any person under the age of 18 who does not have an accompanying adult, legal guardian, or approved operator.

A parent or legal guardian may be required to sign a waiver or consent form on behalf of a minor before participation.

Safety is our highest priority.
 

All customers must attend and follow the mandatory safety briefing before participating in any Beachy activity. Customers must comply with all instructions given by Beachy staff, guides, operators, safety personnel, and authorised representatives.
 

Customers are required to wear all safety equipment provided, including life jackets and any other required protective gear.
 

Failure to follow instructions may result in immediate cancellation or termination of the activity without refund.

Customers must behave responsibly, respectfully, and safely at all times.
 

Beachy reserves the right to refuse service, cancel a booking, stop an activity, or remove any person from participation if that person:

  • Appears to be under the influence of alcohol, drugs, or any substance that may impair judgment;

  • Refuses to follow safety instructions;

  • Acts aggressively, abusively, recklessly, or disrespectfully;

  • Puts themselves, Beachy staff, other customers, the public, equipment, or the environment at risk;

  • Provides false information;

  • Fails to meet safety, age, health, or operational requirements.
     

In such cases, no refund will be guaranteed.

Customers must not participate in any Beachy watersport activity while under the influence of alcohol, illegal drugs, or any medication or substance that may affect balance, coordination, reaction time, awareness, or judgment.
 

Beachy reserves the right to deny participation where impairment is suspected, even if the customer has already paid.

Customers are responsible for determining whether they are physically and medically fit to participate in Beachy activities.
 

Watersport activities may involve movement, speed, waves, impact, sun exposure, water exposure, and physical exertion. Customers with medical conditions, injuries, mobility limitations, heart conditions, back or neck issues, pregnancy, recent surgery, fear of water, or any other health concerns should seek medical advice before booking.
 

Beachy reserves the right to deny participation if a customer appears unfit to participate safely.

All Beachy activities are subject to weather, sea conditions, tides, visibility, mechanical readiness, safety assessments, government regulations, and operational approvals.
 

Beachy reserves the right to delay, modify, relocate, reschedule, shorten, or cancel an activity where conditions are considered unsafe or unsuitable.
 

Weather-related cancellations or changes will be handled in accordance with Beachy’s Refund Policy.

Customers may be required to sign a waiver, release, indemnity, or participation form before taking part in any Beachy activity.
 

By participating, customers acknowledge that watersport and beach activities carry inherent risks, including but not limited to slips, falls, water impact, changes in sea conditions, equipment movement, sun exposure, minor injuries, serious injury, or other unforeseen events.
 

Customers participate voluntarily and agree to follow all safety rules and instructions.

​All equipment provided by Beachy must be used responsibly and only for its intended purpose.
 

Customers may be held financially responsible for damage, loss, theft, or misuse of Beachy equipment, property, vessels, safety gear, accessories, or facilities caused by negligence, recklessness, intentional misconduct, or failure to follow instructions.
 

Beachy reserves the right to charge repair or replacement costs where applicable.

Customers are responsible for their personal belongings, including phones, cameras, bags, jewels, eyewear, clothing, cash, cards, and valuables.
 

Beachy is not responsible for lost, stolen, misplaced, damaged, or water-damaged personal items.
 

Customers are encouraged to leave valuables in a safe location before participating in any water-based activity.

Beachy may capture photos or videos for promotional, safety, operational, or customer experience purposes.
 

By participating in Beachy activities or entering a Beachy-branded experience area, customers acknowledge that their image, likeness, voice, or activity may appear in Beachy content, unless they notify Beachy in writing that they do not wish to be photographed or recorded.
 

Customers who purchase or receive photo or video content may use it for personal purposes. Commercial use, brand promotion, resale, or third-party use of Beachy-generated content requires written permission from Beachy.

Customers are welcome to capture their own content where it is safe to do so and does not interfere with operations, staff instructions, other customers, or safety procedures.
 

Beachy reserves the right to restrict the use of cameras, drones, phones, or other recording devices where necessary for safety, privacy, legal, operational, or environmental reasons.
 

Drone use is not permitted without prior written approval and compliance with applicable aviation and site regulations.

All cancellations, rescheduling requests, no-shows, late arrivals, weather disruptions, and refund requests are governed by Beachy’s Refund Policy.
 

Customers are encouraged to read the Refund Policy carefully before booking.

Beachy reserves the right to refuse service, cancel participation, remove a customer from an activity, or deny access to any person where Beachy determines that doing so is necessary for safety, legal, operational, environmental, reputational, or customer experience reasons.

Beachy services are subject to availability and may vary by date, season, location, weather, staffing, equipment readiness, approvals, and demand.
 

Beachy does not guarantee that all services, packages, promotions, or booking times displayed on the website will be available at all times.

Prices are listed in Trinidad and Tobago Dollars unless otherwise stated.
 

Beachy reserves the right to update prices, packages, promotions, inclusions, and service offerings at any time. Promotional offers may be subject to specific terms, blackout dates, availability, and expiry dates.

Customers agree not to misuse the Beachy website, interfere with its operation, attempt unauthorised access, submit false information, copy website content without permission, or use the website for unlawful, harmful, misleading, or fraudulent purposes.

All Beachy names, logos, taglines, designs, website content, photographs, videos, graphics, service descriptions, branding, and other materials are owned by or licensed to Beachy Beach Club & Jetcar Rentals Ltd.
 

No content from this website or any Beachy platform may be copied, reproduced, modified, distributed, or used commercially without written permission from Beachy.

To the fullest extent permitted by law, Beachy Beach Club & JetCar Rentals Ltd., its directors, employees, contractors, operators, agents, partners, and representatives shall not be liable for any loss, injury, damage, delay, inconvenience, expense, or claim arising from:

  • Customer failure to follow instructions;

  • Unsafe or reckless behaviour;

  • Weather or sea conditions;

  • Service delays or operational changes;

  • Personal medical conditions;

  • Loss or damage to personal belongings;

  • Third-party actions;

  • Events outside Beachy’s reasonable control.
     

Nothing in these Terms and Conditions is intended to exclude liability where such exclusion is not permitted by law.

Customers agree to indemnify and hold harmless Beachy Beach Club & Jetcar Rentals Ltd., its directors, staff, contractors, operators, agents, and representatives from any claims, damages, losses, costs, liabilities, or expenses arising from the customer’s breach of these Terms and Conditions, unsafe conduct, misuse of equipment, negligence, or failure to follow instructions.

Beachy shall not be liable for delays, cancellations, changes, or failure to provide services caused by circumstances beyond its reasonable control, including but not limited to severe weather, unsafe sea conditions, natural disasters, government restrictions, public health events, equipment failure, power outages, civil unrest, emergencies, or other unforeseen events.

Beachy may update these Terms and Conditions from time to time. Updated versions will be posted on the website with a revised “Last Updated” date.
 

Continued use of the website, booking system, or Beachy services after changes are posted means that the customer accepts the updated Terms and Conditions.

These Terms and Conditions shall be governed by the laws of the Republic of Trinidad and Tobago.
 

Any disputes arising from the use of Beachy’s website, bookings, services, or activities shall be handled in accordance with the laws and applicable courts of Trinidad and Tobago.
